TRADEMARK REGISTRATION IN KUWAIT

Trademark registration is governed by Articles 61-95 of Trade Law No. 68 of 1980. A trademark can include words, symbols, letters, designs, or combinations that distinguish goods or services as originating from a specific owner.

Non-Registrable Marks:

  1. Non-distinctive marks or those describing goods in a generic or customary manner.

  2. Marks violating public morals or order.

  3. State, UN, or reciprocal country emblems and flags without authorization.

  4. Symbols of the Red Cross, Red Crescent, or similar.

  5. Religious symbols.

  6. Geographical names causing origin confusion.

  7. Names, photos, or emblems of third parties without consent.

  8. Titles of honor without lawful entitlement.

  9. Marks that mislead or contain false product information.

  10. Marks deemed identical or similar to Israeli symbols by the Boycott of Israel Office.

Documents Required for Trademark Registration in Kuwait:

  1. Filled trademark application.

  2. 12 images of the trademark.

  3. Copy of commercial license and register certificate.

  4. Copy of authorization and signature authorization.

  5. Copy of the mark with applicant details (name, address, nationality).

  6. Comprehensive list of goods/services (Classes) translated to Arabic.

  7. Power of Attorney (POA), notarized/legalized at the Kuwaiti embassy, locally legalized, and submitted at filing.

  8. Commercial certificate and priority document translated to Arabic (if claimed), submitted within 60 days.
     

For Trademark Renewal:

  1. Details of the mark.

  2. Applicant details (name, address, nationality).

  3. POA.

  4. Original trademark registration certificate.

  5. Commercial certificate copy.
     

For Trademark Assignment:

  1. Details of the mark.

  2. Applicant details (name, address, nationality).

  3. Assignment details and document (Arabic translation, legalized at Kuwaiti embassy).

  4. POA.

  5. Commercial certificate (Arabic translation).
